On November 8,
1994, the Illinois Environmental Protection
Agency (Agency) filed a motion requesting waiver of application
of Section 28.5(g) of the Act.
Section 28.5(g) requires that
testimony for hearings in rulemakings proceeding under Section
28.5 be prefiled 10 days before the hearing unless a waiver is
granted for good cause.
The motion is denied; however, the Board
notes that as time allows
persons may testify who did not
prefile.

1992.)
Therefore, the Agency
will be able to testify as necessary.
