ILLINOIS POLLUTION CONTROL BOARD
November 20, 1986
THE NEW JERSEY ZINC CO.,
Petitioner,
v.
)
PCB 86—187
ILLINOIS ENVIRONMENTAL PROTECTION
)
AGENCY,
Respondent.
ORDER OF THE
BOARD
(by
J. Anderson):
This petition, filed October
24,
1986,
is unclear
or
deficient in two respects:
1)
The Board
grants variance from NPDES permit conditions
to the extent that such conditions are derived from
Board
regulations.
While
it would
appear that variance
may be necessary from 35
Ill.
Adm.
Code 304.124
(see
Pet.
pars.
14—15), petitioner should
specify from which
Board regulations variance
is sought.
2)
The mere statement of an intent to
file
a petition for
site—specific relief
is
an insufficient compliance plan.
If an
amended petition curing
these deficiencies
is not
filed within 45 days of the date of this Order,
this petition
will
be subject
to dismissal.
IT IS SO ORDERED.
I, Dorothy M.
Gunn, Clerk of the Illinois Pollution Control
Board,
hereby
certify
