    This matter comes before the Board on a July
    23,
    1990
    petition for review of denial of trade secret/confidentiality
    filed by the Grigoleit Company.
    The Illinois Environmental
    Protection Agency
    (Agency)
    filed a response
    to the petition on
    September
    19,
    1990.
    On October
    9,
    1990 the Grigoleit Company
    filed its reply the Agency’s response.
    This matter
    is set for hearing.
    Hearing
    is to be scheduled
    as expeditiously as possible.
    The hearing officer shall inform
    the Clerk of the Board of the time and location of the hearing at
    least
    40 days
    in advance of hearing so that public notice of
    hearing may be published.
    After hearing,
    the hearing officer
    shall submit an exhibit list, and all actual exhibits
    to the
    Board within
    5 days of hearing.
    Any briefing schedule shall
    provide for
    final filings as expeditiously as possible.
    At hearing the parties shall provide the Board with copies
    of
    2
    Ill.
    Adm. Code 1827 and shall address whether the document
    tendered to the Agency inspector on or about January
    26,
    1990
    constitutes delivery of a letter of justification in support of
    trade secret/confidentiality status.
    Until such time as the Board shall make its final
    determination in this matter,
    the Agency
    is directed to maintain
    the confidentiality of the disputed documents.
