This matter is before the Board on an August
23,
1994 status
report filed by petitioner Moline/Dutchway Dry Cleaners
(Dutchway).
Dutchway states that after discussing the case with
the Illinois Environmental Protection Agency (Agency),
it appears
that the Agency can take further action only after the Office of
the State Fire Marshal
(OSFM) provides further direction.
Dutchway further states that it is attempting to obtain a further
review by OSFN, but is not able,
as of the date of the status
report, to report on any further determination by OSFM.
Finally,
Dutchway states that the Agency has no objection to continuing
this case pending further review by OSFM.
The Board accepts Dutchway’s status report.
We will grant a
temporary 120-day stay of this proceeding to allow time for
review by OSFM.
Dutchway is directed to file an updated status
report with the Board no later than January
5,
1995.
