Respondent.
ORDER OF THE BOARD
(by J. Theodore Meyer):
This matter is before the Board on respondent the Village of
Hampshire’s October 17,
1994 motion to supplement the record on
appeal.
Petitioner Solvent Systems International,
Inc.
(Solvent
Syste~is)has not filed a response to the motion.
The Village seeks
to supplement the record with a certified
copy of its Ordinance 91—1 “An Ordinance to Provide for
Reimbursement of Certain Engineering and Attorney’s Fees Related
to Building,
Zoning, Annexation, Subdivision, and Related
Matters”.
The Village states that Solvent Systems has argued
that the Village had no ordinance requiring payment of fees in
connection with the siting review process.
The Village contends
that Ordinance 91-1, which was in effect during the siting review
process at issue in this case,
is such an ordinance.
Thus,
the
Village seeks to add that ordinance to the record,
so that it can
fully respond to Solvent Systems’ argument.
The motion to supplement the record is granted.
IT IS SO ORDERED.
