HEARING OFFICER ORDER
On September 15, 2005, all parties participated in a telephonic status conference. The
complainant represented that it is still awaiting the Benefit Economic Cost Analysis (BEN) from
the Illinois Environmental Protection Agency that will be used in the penalty demand. Due to an
issue regarding service of the amended complaint, the hearing officer set the due date for the
answer of October 24, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on November 3, 2005, at 11:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
