    ORDER
    OF
    THE
    BOARD
    (by C. A. Manning):
    This
    matter is before the Board on an amended petition for
    review filed by the U.S. Department of
    Army
    (Department) on
    January 19,
    1993.
    The Department had also filed an open waiver
    from the statutory decision deadline on January 26, 1993.
    The
    Department is requesting the Board to review the Illinois
    Environmental Protection Agency’s (Agency) denial of its
    RCRA
    Part B permit.
    On February
    3,
    1994, we directed the Agency to
    file a status report in this matter.
    The
    Agency filed the status
    report on February 14,
    1994.
    The status report filed by the Agency indicates that the
    parties are attempting to resolve
    this
    matter without proceeding
    to hearing.
    The Agency states that the Department has filed a
    new Part-B application and it has been reviewing the application.
    The parties have also been in “periodic communication relating”
    to the application.
    Finally, the Agency comments that the
    Department has represented that it may close its facility and
    withdraw the amended petition for review.
    The parties are directed to file, jointly or individually, a
    status report on or before May 27,
    1994.
