The Agency moves

to dismiss its complaint without prejudice

on the grounds that the respondent has ceased business that

it is involved in a bankruptcy proceeding, and that its assets

are to be auctioned piecemeal.

No resumption of business or

of pollution is contemplated, and any penalty would only reduce

the pool for innocent creditors.

The complaint is hereby

dismissed without prejudice.
