ORDER OF THE BOARD

This matter comes before the Board on a “Motion for Relief

from Filing Requirements” filed by petitioner on September 22,

1994.

Petitioner filed a petition for variance with the Board on

September 19,

1994,

for a variance from 35 Ill. Adm. Code

814.104(c).

Petitioner is requesting relief from the filing

requirements of 35

Ill.

Adm. Code 101.103(b)

and 104.120

requiring that an original plus nine copies of the petition be

filed with the Board and that a copy of the petition be served on

the Illinois Environmental Protection Agency

(Agency).

Petitioner is requesting that it be required to file only

one copy of the supplemental exhibit containing information

required to be included in its application for significant

modification.

The petitioner contends that this information has

already been submitted to the Agency.

In addition, petitioner

contends that the information is voluminous and is submitted for

the limited purpose of

demonstrating petitioner’s good faith and

diligence in complying with the regulation from which petitioner

seeks a variance.

The Board denies petitioner’s motion.

The Board will

require petitioner to file three additional copies of the

supplemental exhibit to provide copies of the exhibit to each of

the Board’s offices.

Unless requested by the Agency, the Board

will not require petitioner to file a copy of the exhibit with

the Agency.
