HEARING OFFICER ORDER
On October 5, 2004, the parties informed the hearing officer that they continue to await
the decision of the Illinois Environmental Protection Agency (Agency) regarding a penalty
calculation. It is noted that the Agency has been attempting to calculate the penalty calculation
since at least December 16, 2003.
The parties are directed to participate in a telephonic status call with the hearing officer on
December 2, 2004, at 9:45 a.m. The status conference must be initiated by the complainant, but
each party is nonetheless responsible for its own appearance. At the status conference, the
parties must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing.
