OPINION AND ORDER OF THE BOARD

This matter comes before the Board
upon receipt
of a June
15, 1988, Agency Recommendation.
The Agency recommends
the Board
grant the requested provisional variance from 35
Ill. Adm. Code
304.120(a).
Petitioner,
the Village of Bluffs owns and operates
a 0.135
MGD,
DAF wastewater
treatment facility.
Effluent
is discharged
to Wolfrun Creek, Coon Run Creek,
and
the Illinois River.
Petitioner has decided
to install new aeration equipment,
requiring the lowering
of water levels
in
3 lagoon cells.
Therefore,
a variance
is needed for dewatering wastewater from
the lagoons.
Because dewatering of
the lagoons
is essential
for
completion of necessary work,
the Illinois Environmental
Protection Agency agrees with Petitioner,
that denial
of the
requested provisional variance would work an arbitrary and
unreasonable
hardship
on
the
Village
of Bluffs.
The Agency also
agreed that environmental
impact would be minimal and that no
public
water
supplies
would be adversely affected by granting the
requested provisional variance.
ORDER
The Board hereby grants the Village
of Bluffs
a provisional
variance from 35
Ill. Adm. Code 304.120(a) subject
to the
following conditions:
a.
Variance shall commence upon June
17,
1988 or when
dewatering of the
lagoons
is begun, which ever occurs
first.
b.
Variance shall
terminate when all
the wastewater which
can be drained by gravity (top five feet)
is discharged
or
June
30,
1988,
whichever
occurs
first.

c.
Petitioner’s effluent
shall be
limited
to
50 mg/l BOD
and 75 mg/i TSS, both monthly averages.
d.
Petitioner shall
sample their effluent weekly
for the
parameters mentioned
in their NPDES permit and report
their results on their DMR.
e.
Petitioner
shall notify Bud Bridgewater of the Agency’s
Springfield Regional Office via telephone at 217/786—
6892 when dewatering
is begun, when the work
is
completed and when the lagoons are refilling.
Written
notification confirming
the telephone notification
shall be submitted within
5 days thereof.
Written
confirmation of each notification shall
be sent within
5 days

Petitioner
shall
at all times continue
to disinfect its
effluent discharge.
g.
Petitioner shall
operate and maintain the wastewater
treatment facility so
as
to produce the best effluent
practicable.
h.
Petitioner
shall, within 10 days of the date of
this
Order, execute a Certificate
of Acceptance and
Agreement which
shall be sent
to Mark
T. Books at the
address indicated above.
This variance shall
be void
if Petitioner
fails
to
execute and forward the certificate within
the ten day
period.
The ten day period shall
be held in abeyance
during
any period that this matter
is being appealed.
The form of said Certification shall
be
as follows:
