    This matter comes before the Board upon
    a complaint
    filed
    November
    1,
    1988.
    Hearing was held January
    18,
    1989,
    at which
    time
    a signed Stipulation and Proposal
    for Settlement
    (“Stipulation”) was submitted by the parties
    for acceptance by
    the Board.
    The Stipulation addresses the facts and proposed
    terms of settlement
    in this matter.
    The Respondent, Ekco
    Housewares,
    Inc., admits
    to violations of Section 9(a)
    of the
    Act,
    Ill.
    Rev.
    Stat.,
    (1987),
    ch.
    1111/2,
    par.
    1009(a)
    and
    35
    Ill. Adm.
    Code 201.143.
    The Board
    finds
    the Stipulation acceptable under
    35 Ill.
    Adm.
    Code 103.180.
    This Opinion constitutes
    the Board’s findings of fact and
    conclusions of law in this matter.
    ORDER
    1.
    The Board accepts
    the Stipulation and Proposal for
    Settlement, which
    is hereby incorporated by reference as
    if fully set forth herein.
    2.
    The Board
    fjnds that the Respondent, Ekco Housewares,
    Inc., violated Section
    9(a)
    of the Illinois
    Environmental Protection Act,
    Ill.
    Rev.
    Stat.
    (1987),
    ch.
    111
    1/2, par.
    1009(a)
    and
    35 Ill.
    Adm.
    Code 201.143.
    3.
    Respondent
    shall pay the penalty of $12,000 within 30
    days of this Order.
    Such payment shall
    be made by
