ORDER OF THE BOARD

On January
9,
1991, the Board received documents purporting
to be the record of this proceeding.
Those documents are not
accepted as filing of the record as required by the Board’s Order
of December
20,
1990.
In that prior Order the Board stated:
The record shall contain the originals of all
documents,
shall be arranged as much as is
possible
in chronological sequence,
and shall
be sequentially numbered, placing the letter
“C” before the number of such page.
In
addition to the actual documents which
comprise the record,
the Madison County Clerk
shall also prepare a document entitled
“Certificate of Record on Appeal” which shall
be an index of the record that lists the
documents comprising the record.
Seven copies
of the certificate, seven copies of the
transcript of the Madison County hearing and
three copies of any other documents in the
record shall
be filed with the Board, and a
copy of the certificate shall
be served upon
the petitioner(s).
Neither the documents filed,
nor the Certificate of Record
on Appeal are numbered in any manner.
This failure to page
number documents makes identification of any particular piece of
the record extremely difficult, especially here where the record

is approximately two feet of paper.
The Board will require the
County to paginate each document
in the record.
In addition, the
Index of Record or Certificate of Record on Appeal must contain
the beginning and ending page number
for each document
described.
Finally,
the Board requires three
(3)
copies of the
record to be filed, not one copy.
The Board will therefore Order
the County to file three copies of an accurately paginated
record, as well as a revised Index of Record reflecting the
accurate page numbers.
For information purposes, the Board is
attaching a copy of a correct index of record from
a recent case
as an example.
See attachment A to this Order.
The Clerk of the Board
is directed to contact the County
Clerk and
to arrange for
filing, as soon as possible but not
later than February 1,
1991, of a correct record in the most
effective manner.
The Board notes that the record filed contains certain
oversized exhibits, certain physical evidence
(a sample of
polyethylene landfill liner material, and a videotape) which
cannot be easily reproduced.
The Board hereby grants permission
to file just the one original of these materials,
but they must
be properly identified and labelled.
