    INTE?JM ORDER OF THE BOARD
    (by Dr. Odell):
    On February 6,
    1975,
    the City of Rushville filed a Petition
    For Variance with the Illinois Pollution Control Board
    (Board).
    Petitioner sought
    a variance from Rule 203(h)
    of the Water Pol-
    lution Regulations to enable it to apply a
    2 1/2% solution of
    rotenone
    to its artificial lake above the
    dam
    being constructed
    3 miles south of the town.
    The Environmental Protection Agency
    recommended on March
    11,
    1975,
    that the variance be denied.
    It
    stated that the information filed was insufficient to enable the
    Board to rule on the request.
    We concur.
    Petitioner is requested to
    :Eile by April
    25,
    1975,
    the following information:
    1.
    Disposal methods to be carried out for the dead fish
    after the kill has taken place.
    2.
    Methods available to detoxify the treated water
    if
    treatment should be necessary while the rotenone is still toxic.
    3.
    Evidence indicating that landowners along the treated
    area of the Crane Creek will abide by the City’s plan, including
    the City’s request to avoid use of the affected waters until
    fingerling trout or bluegill survive for 48 hours
    in livecars
    placed in the treated waters.
    The 90-day period for Board decision shall run from the
    time of the filing of the Amended Petition.
    Failure to file the
    information by April
    25,
    1975, will make the Petition For Variance
    subject to dismissal for inadequacy.
