    ORDER OF THE BOARD

    This proceeding
    is an appeal from a permit denial issued
    by the Environmental Protection Agency.
    Petitioner Mobil Oil
    Corporation now moves that the proceeding be dismissed,
    stating that the Agency has made two revisions during the
    pendency of this appeal and that Petitioner now possesses an
    operating permit which would appear to “contain such general
    and special conditions as are consistent with the accord
    previously reached”.
    The controversy has apparently been
    resolved and we will dismiss
    the appeal without prejudice.
    It is ordered that this proceeding be dismissed without
    prejudice.
