Celotex’ September 15,
1980 motion for reconsideration of the
Board’s Order of September 4,
1980 is denied.
The Agency’s August 27,
1980 motion to strike and to grant
sanctions was mooted by the Order of September
4,
1980 (although
said motion was referred to incorrectly
as
being filed on August
29,
1980).
Regardless of whether the Board would be inclined to
grant sanctions against Celotex,
such action is “discovery—related.”
It therefore would be inconsistent with its prior order for the
Board to issue orders related to discovery—related motions.
IT IS SO ORDERED.
