    HEARING OFFICER ORDER
     
     
    On October 29, 2004, petitioner participated in a telephone status conference with the
    hearing officer. Respondent did not appear. Petitioner is still waiting to hear from respondent’s
    technical unit regarding how petitioner should proceed with the site clean-up. Once the plan is in
    place, petitioner may move to dismiss this appeal.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 9:30 a.m. on November 30, 2004. The telephone status conference will be initiated by
    the petitioner. At the status conference, the parties must be prepared to discuss the status of the
    above-captioned matter.
     
    The petitioner has filed an open waiver of the decision deadline in this matter.
