1979 Petitioner requested a
variance
from Rule 205(m)(3)
of the Air Pollution Control
Regulations.
The Petition
is deficient
in several respects.
First,
it fails
to state the size of Petitioner’s
business
as required by Procedural Rule
401(a)(2),
Second,
it fails
to indicate the quantity of organic material
emitted from
Petitioner’s facilities as required by Procedural
Rule
401(a)(4),
Third,
it fails to describe a detailed
program
including costs and schedules to come into compliance with
the Air Pollution Control Regulations
as required
by
Procedural Rule 401(a)(6),
Fourth,
it fails
to
assess
the
environmental impact of granting a variance as required by
Procedural Rule 401(a)(7),
Fifth,
it fails
to
specifically
request or waive a hearing as required by
Procedural Rule
401(b),
Consequently this matter
is hereby dismissed
without prejudice.
If Petitioner wishes to refile this
matter with the corrections noted here,
it should feel free
to do so.
