PETITIONER'S RESPONSE TO RESPONDENT'S MOTION FOR LEAVE TO
FILE THE ADMINISTRATIVE RECORD ON A SET OF COMPACT DISCS
NOW COMES the Petitioner, by its Attorneys, James T . Harrington, David R. Rieser and
McGuireWoods LLP and for its Response to Respondent's Motion for Leave to File the Administrative
Record on a Set of Compact Discs, states as follows .

Petitioner has no objection to the Respondent filing the Administrative Record on a set of
compact discs as set forth in the Respondent's Motion provided that Respondent provides a complete
index to the record correlated with the bates-stamped numbers and further provided that Respondent
agrees that in the event of technical difficulties in the scanning or accessing of the documents in the
record, Respondent agrees that hard copies of the documents will be promptly provided to the Board and
Petitioner .
