    OPINION AND ORDER
    OF THE BOARD

    This matter
    conies before
    the Board upon
    a January
    7,
    1987
    recommendation of the Illinois Environmental Protection Agency
    (Agency)
    that petitioner be granted
    a 45—day provisional variance
    from 35
    Iii.
    Adni.
    Code 304.120(b)
    in order
    for petitioner
    to
    perform the necessary repairs
    to
    its primary clarifier at
    its
    wastewater
    treatment facility
    in Cuincy, Adams County,
    Illinois.
    The Agency has
    found that compliance with Section
    304.120(b)
    on
    a short—term basis would
    impose
    an arbitrary or
    unreasonable hardship on petitioner
    and recommends that
    petitioner
    be granted
    provisional variance, subject
    to
    conditions.
    The
    Board agrees and hereby grants petitioner
    a
    45—
    day provisional variance from 35 Ill. Adm. Code 304.120(b)
    subject
    to the following conditions:
    1.
    The provisional variance shall
    commence on December
    2,
    1986
    and terminate on January 15,
    1987 or when the
    primary clarifier
    is returned
    to
    service, whichever
    occurs
    first.
    2.
    Petitioner
    shall continue
    to sample and analyze
    its
    discharge
    as specified
    in its NPDES permit 1L0003247.
    3.
    Petitioner
    shall proceed with
    its plans
    to install
    treatment unit bypasses by March
    1, 1987.
    4.
    Petitioner
    shall
    repair
    the primary clarifier
    and return
    the treatment facility
    to operation as quickly as
    possible.
    5.
    Petitioner
    shall notify Pat Lindsey of the
    Illinois
    Environmental Protection Agency’s
    Compliance Assurance
    Section via telephone at 217/782—9720 when
    the primary
    clarifier
    is returned
    to service.
    written verification
    shall
    be submitted within
    5 days
    to:

    Within
    10 days of the date
    of the Board’s Order,
    petitioner

    Agreement which

    be sent to Mr.
    James
    Frost of
    the
    Agency at the address noted
    in condition No.
    5.
    This
    certificate shall have the
    following form:

    Quincy Plant hereby accepts and agrees
    to
    be bound
    by all
    the terms
    and conditions of the Crder of the
    Illinois Pollution Control Board
