HEARING OFFICER ORDER
On August 25, 2005, the complainant informed the hearing officer that respondents
Wooten Construction, Ltd., and Smithfield Properties L.L.C., (Wooten) are still proceeding with
discussions with their consultant and affected homeowners regarding an attempt to resolve this
matter. The complainant represented that it and the
Chicago Sun-Times Inc
., have reached a
settlement and that a stipulation and proposal for settlement is being circulated for signatures.
The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on October 27, 2005, at 9:45 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the conference the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
