Opinion and Order of the Board
(by Mr. Currie):
The company seeks
a variance to burn scrap lumber up
to
five
hours each week.
This lumber
is collected from Chrysler~s
Belvidere plant and is normally disposed of in a landfill; the
petition asks
to burn it when the landfill unloading equipment
has broken down and on Saturday afternoons when the landfill is
closed. We think these allegations are insufficient
to support
the grant of a variance even
if all the facts alleged are proved.
Consequently no purpose would be served by
a hearing, and the
petition will be dismissed,
Variances are reserved for cases
of arbitrary or unreasonable hardship; we cannot see that having
to make temporary arrangements for holding the lumber until the
landfill is able to take it would impose such a hardship as to
justify open burning,
Variances are not lightly to be granted.
The petition is dismissed.
