These two
cases

an enforcement and
a variance
——
were
consolidated for hearing which was held on July
19,
1973.
The parties at that time informed
the Hearing Officer
that
they
~iad entered into
an agreement which they believed would
disoose of all
the issues, consistent with the public interest.
The ~iarties described the agreement and said they would file
si~i~d copies of the settlement agreement and
the recommendatio~i
of the EPA
in the following week.
We have not received the signed agreement.
The Agency has
not filed
a Recommendation in
the variance case.
Our decision
in the variance case
is due September
26,
1973.
We are now informed that there
is no
longer an agreement
and the cases should be set for hearing.

We shall schedule the cases for consolidated hearing
if Stepan Chemical Company gives an appropriate extension
of time within which we can decide the variance case.
If
Stepan Chemical does not provide us with the necessary
waiver, we will decide the variance case on
the record
presented to date and without further hearing.
In that
event,
the cases will be severed and the enforcement case
will be scheduled for hearing.
