ORDER OF THE BOARD
(by J. Anderson):
This matter is before the Board on the Illinois
Environmental Protection Agency’s (Agency)
December
4, 1992
motion for reconsideration.
ESG Watts, Inc. has failed to file a
response.
The Agency asks that the Board reconsider its October
29,
1992 opinion and order which found that the
Agency improperly
denied ESG’s special waste stream permit applications.
The
motion for reconsideration raises no new issues of tact or law.
therefore, the Board finds no reason for reconsideration.
The
Agency’s motion for reconsideration is denied and the
Board
reaffirms its October 29,
1992 opinion and order.
IT IS SO ORDERED.
Section 41 of the Environmental Protection Act
(Ill.
Rev.
Stat.
1991,
ch.
111 1/2, par.
1041) provides for the appeal of
final Board orders,within 35 days.
The Rules of the Supreme
Court of Illinojs establish filing requirements.
