    This matter is before the Board on a March
    15,
    1993
    motion to file the record instanter,
    filed by the Illinois
    Environmental Protection Agency (Agency).
    The petition was
    filed with the Board on October 29,
    1992.
    Pursuant to 35
    Ill.
    Adm. Code 105.102(a) (4), the Agency record is to be filed with
    the Pollution Control Board within 14 days “upon notice of the
    petition”.
    On December 3,
    1993,
    the Board granted a stay of this
    matter until February 26,
    1993.
    On March 11,
    1993 the Board
    granted an extension of the stay until October 25,
    1993.
    The
    Agency believes that the petitioner will not be prejudiced by the
    filing of the Agency record at this time.
    The motion to file the record instanter is granted.
