JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31 .1 of the Illinois Environmental Protection Act, 415
ILCS 5/31.1 (2004) .
FACTS
1
.
That Georgia Shank is the present owner and Steve Shank is the present operator
(collectively "Respondents") of a facility located at Route 40 and Elm Street, Greenville, Bond
County, Illinois. The property is commonly known to the Illinois Environmental Protection Agency as
Greenville/Shank, Steve
.

.
That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No . 0050055070
.

.
That Respondents have owned and/or operated said facility at all times pertinent
hereto .

.
That on November 15, 2005, Kendall Couch of the Illinois Environmental Protection
Agency's Collinsville Regional Office inspected the above-described facility.
A copy of his

 
inspection report setting forth the results of said inspection is attached hereto and made a part
hereof.
VIOLATIONS
Based upon direct observations made by Kendall Couch during the course of his November
15, 2005 inspection of the above-named facility, the Illinois Environmental Protection Agency has
determined that Respondents have violated the Illinois Environmental Protection Act (hereinafter,
the "Act") as follows
:
(1)
That Respondents caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2004) .
(2)
That Respondents caused or allowed the open dumping of waste in a manner
resulting in open burning, a violation of Section 21(p)(3) of the Act, 415 ILCS
5/21 (p)(3) (2004) .
That Respondents caused or allowed the open dumping of waste in a manner
resulting in the deposition of general construction or demolition debris; or clean
construction demolition debris, a violation of Section 21(p)(7) of the Act, 415 ILCS
5/21 (p)(7) (2004) .
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2004), Respondents are
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500 .00) for each of the
violations identified above, for a total of Four Thousand Five Hundred Dollars ($ 4,500.00) .
If
Respondents elect not to petition the Illinois Pollution Control Board, the statutory civil penalty

specified above shall be due and payable no later than January 31, 2006,unless otherwise provided
by order of the Illinois Pollution Control Board
.
If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31 .1 of the Act, 415 ILCS 5/31 .1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board
. Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500 .00) statutory civil penalty for each
violation .
Pursuant to Section 31 .1 (d)(1) of the Act, 415 I LCS 5/31 .1(d)(1) (2004), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service,
the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative
Citation and findings of violation as
alleged herein, and shall impose the statutory civil penalty specified above
.
When payment is made, Respondent's check
shall be made payable to the Illinois
Environmental Protection Trust Fund
and mailed to the attention of Fiscal
Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Along with payment, Respondents shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment
.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of the
Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued
.

Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois

60601 . A copy of said Petition for Review shall be filed with the Illinois Environmental Protection

Narrative
General Remarks
On November 15, 2005, 1 went to the Greenville, Illinois to investigate a complaint
involving a tire fire. The weather was cloudy, wet, and temperature was 50° F . The
owner of this site, Georgia Shank, was not present during this inspection
.
History
On August 25, 2004, a complaint was received by the Agency stating that this site was
dumping and burning household garbage. On September 3, 2004, I went to this site
.
When I arrived I observed six 55-gallon drums and a dumpster located at this site
.
Four of the drums were full of burned material and the fifth was partially full . The last
drum was empty and lying on its side . The dumpster was half full of building materials
and other miscellaneous items .
To the east of the dumpster was a burned area approximately 10 feet by 15 feet . This
burned area was smoldering during this inspection. It appeared wood and brush had been
ignited recently. Just to the south of this burned are was a darkly stained area covered
with an unknown absorbant
.
An Administrative Warning Notice was sent to Steve Shank alleging several violations of
the Illinois Environmental Protection Act . Steve Shank responded to the ACWN and
cleaned the site. A Return to Compliance Letter was then sent to Mr. Shank .
Inspection
Mr. Shank had recently had several tons of tire shred delivered to this site. The tire shred
was to be used as fill for a future construction project. The tire shred came from Century
Mulch of Mulberry Grove, Illinois . Century Mulch is located approximately 5 miles to
the east on US Highway 40 . 1 spoke to Mr. Shank on November 10, 2005 via phone and
explained that the tire shred was not considered clean fill per the Illinois Environmental
Protection Act
.
The Emergency Response Unit of the Collinsville Regional Office received a complaint
from the Greenville Fire Department on November 14, 2005 . The complaint was referred
to the [EPA Bureau of Land for follow-up. On November 14, 2005, at approximately
6:30am, the Greenville Fire Department was dispatched to a tire shred fire at this site .The
Greenville Fire Department extinquished the fire and left.The Greenville Fire Department
was dispatched again to this site at approximately 10 :30am on that day, and once again
extinquished the fire and left. A fire incident report is attached to this report
.

Compliance File
On November 15, 2005 I spoke with Bill Johnston of the Greenville Fire Department
.
Mr. Johnston explained that he spoke with Mr . Shank and Mr. Shank stated that he was at
this site at 6 :00pm on November 13, 2005 and observed the tire shred burning . Mr. Shank
explained that he did not want to bother the fire department and let the fire continue to
burn. Mr. Shank went back to this site on November 14, 2005 at 6 :30am. He then called
the Greenville Fire Department to report the fire .
Later that day, I went to this site . This site is an open field on the south side of
Greenville. Just south of US Highway 40 is an area with several piles a tire shred on the
east side and a large area covered with half burned tire shred on the west side . The area
smelled of burned rubber .
I then went to the south side of the field where an area contained concrete and tree mulch
.
This area was sited for open burning and dumping back in September of 2004 as
previously stated in the history paragraph of this Narrative . The tree mulch pile was
approximately 4 feet by 10 feet and the concrete pile was approximately 10 feet by 15
feet. The concrete appaired to be from a sidewalk or driveway
.
On November 17, 2005, I went to the Bond County Assessor's Office. This site is owned
by Georgia Shank, wife of Steve Shank according to the Deed aquired from their Office
.
I then went to the site and noticed another large bum pile to the east of the
aforementioned sites. This bum pile was approximately 30 feet in diameter . The burn pile
contained large tree stumps, mattress springs, unburned furniture, a door handle, some
white fiberous material and some solid matter resembling burned roofing material
.
This site is two contiguous pieces of property with the tire shred being on the western
property while this larger burn pile being on the eastern property. Both properties are
owned by Georgia Shank
.
Mr. Shank needs to immediately cease the open dumping and open burning at this site
.
All the burned tire shred and burned waste material must be taken to a permitted landfill
for proper diposal by January 15, 2006 . Receipts from the landfill must be submitted to
the IEPA for review .
During the inspections I observed the apparent violations of 9(a), 9(c), 21(a), 21(d)(1),
21(d)(2), 21(e), 21(p)(1), 21(p)(3), 21(p)(7), 55(a)(1) and 55(a)(2) of the Illinois
Environmental Protection Act
