    In Support ofits filing ofthis Motion for
    Voluntary Dismissal, the Petitioner states as follow:
    1. In January2005,additional information wassuppliedto Illinois EPAthrough a Corrective
    Action Completion Report that
    should address all ofthe concerns ofthe Petitioner and the Illinois
    EPAwith respect to the issues ofthis Appeal.
    Petitionerwishesto continue to workwith the Agency
    on these issues ofwhich unsatisfactory resolution gives rise to newappeal rights such that Petitioner
    is not injured by voluntary dismissal.

    Illinois EPA is aware ofPetitioner intent to voluntarily dismiss and has no objection.
    3.
    No party is prejudiced by the granting of voluntary dismissal.
