HEARING OFFICER ORDER

On May 5, 2005, a telephonic status conference was held. Respondent did not appear.

Petitioner represented discussions in the related enforcement matter are proceeding. The

petitioner also represented that it has received a report by its consultant regarding this permit

appeal and will forward it to the respondent for its review. Petitioner represented that it will file

a 60-day waiver of the statutory decision deadline.

 

The parties or their legal representatives are directed to participate in a telephonic status

conference with the hearing officer on July 14, 2005, at 10:00 a.m. The telephonic status

conference must be initiated by the petitioner, but each party is nonetheless responsible for its

own appearance. At the status conference, the parties must be prepared to discuss the status of

the above-captioned matter and their readiness for hearing.
