ORDER OF THE BOARD
(by Mr. Dumeile):
On November 26,
1979 Petitioner requested a variance
from the effluent standard for total suspended solids in
Rule
408(a) of Chapter 3:
Water Pollution.
The Petition is
deficient in several respects.
First
it fails
to state
a
detailed program to come into compliance with Rule 408(a)
as
required by Procedural Rule 401(a)(6)..
In Paragraph
6 of
the Petition,
Petitioner states that it will not decide
whether to improve its existing facilities or abandon them
until May
30,
1980.
Second,
it fails
to assess the environmental
impact of the requested relief as required by
Procedural
Rule 401(a)(7). Third,
it fails
to describe interim measures
to minimize the impact of the requested relief
as required
by Procedural Rule 401(a)(10).
Consequently this matter
is
hereby dismissed without prejudice.
If Petitioner wishes to
refile its request with the above noted corrections,
it may
do so.
