ORDER OF THE BOARD
(by J.C. Marlin):
On August 10, 1992, the Agency moved for an extension of time
in which to file its record, which was due to be filed August 10,
1992.
In support thereof the Agency states that the parties are
continuing discussions of the issues in this matter, and that use
of scarce resources in assembly of the record would be unnecessary
if
the
matter
is
settled
prior
to
hearing.
Asserting
that
petitioner has no objection to the granting of an extension,
the
Agency requests an extension “until
30 days prior to the date of
hearing”.
The
Board
notes
that
no
hearing
is
scheduled,
and
that
decision has been waived until March
5,
1993.
The
Board
will
grant
an
extension,
but
not
exactly
as
requested by the Agency.
The
Board
disfavors
setting dead1i~e
dates contingent on events which have not occurred.
This places an
undue
burden
on the
Clerk’s
Office case
tracking
system.
The
deadline date for the filing
of the Agency
record
is
extended
through December
15,
1992.
The Agency
may
request
a
further
extension
(if
necessary)
at that
time,
assuming petitioner has
filed an appropriate waiver of the Board’s decision deadline.
