ORDER OF THE BOARD

On August 18,

1994, the Office of the State Fire Marshal

(OSFM)

filed a “Motion for Leave to Supplement the Record on

Appeal Instanter” with a memorandum relating to the preparation

of

the record and the inadvertent omission of two pages of the

Underground Storage Tank Fund Eligibility and Deductibility

Application.

On August 24,

1994, Unocal Corporation

(tJnocal) filed a

motion to dismiss the petition in this matter without prejudice

thereby making the OSFM motion moot.

The Board will construe the

motion to dismiss as a motion to withdraw Unocal’s petition for

review of the OSFM’s Eligibility and Deductibility determination.

The Board hereby grants

the motion to withdraw the petition and

denies OSFM’s motion to supplement as being moot.

The docket in

this matter is closed.
