At its February
4,
1988,
meeting, the Board heard arguments
from the parties
relating
to their
filings
of February 1,
1988,
and February
2,
1988.
The Board
found
that additional
factual
information
is required
to determine if the complained
of
activity meets
the statutory definition of “Organized Amateur
or
Professional Sporting Activity,”
as stated at Section
3.25 of the
Illinois Environmental Protection Act:
°ORGANIZED AMATEUR
OR
PROFESSIONAL
SPORTING
ACTIVITY”
means
an
activity
or
event
carried
out
at
a
facility
by
persons
who engaged
in
that activity as
a business
or
for education,
charity
or
entertainment
for
the
general
public,
including
all
necessary
actions
and
activities
associated
with
such
an
activity.
This definition
includes,
but
is
not
limited
to,
skeet,
trap
or
shooting
sports
clubs
in
existence prior
to January
1,
1975,
organized
motor sports,
and sporting events organized or
controlled
by school districts, units of local
government,
state
agencies,
colleges,
univer-
sities
or
professional
sports
clubs
offering
exhibitions to
the public.
Specifically, the Board orders the parties to
file,
not
later than Tuesday, February 16,
1988,
a verified statement of
facts, describing what degree of involvement
the general public
has with such activity and whether
such activity offers
exhibitions
to the public.
The Board
intends to rule on the pending motion to dismiss
at the regularly scheduled February
25,
1988, meeting.
