v.
LAKELAND PARK WATER COMPANY,
Respondent.
ORDER OF THE BOARD
(by Mr. Goodman):
This matter comes before the Pollution Control Board
(Board)
upon the Respondent’s April
14,
1976 Motion for Modification of the
Board Order,
herein,
of October
30,
1975.
It is the opinion of the
Board that this motion is inappropriate.
Section
33(c)
of the En-
vironmental Protection Act required public notice and hearing
in
this matter.
The Board’s decision was based upon said hearings.
The Board is
loath to amend its Order without providing an oppor-
tunity to citizens who may be affected to participate.
Repondent’s
motion is in substance
a variance request and that procedure
is
available to
it.
See Procedural Rule
334.
Therefore the Board will
deny Respondent’s motion.
IT IS SO ORDERED.
