    ORDER OF THE BOARD
    (by Mr. Dumelle):
    Variance is granted from Rules 203(a),~403 and 404(f)
    of Chapter Three, Water Pollution Regulations for a one year
    period from September 23, 1974 through September 22,
    1975
    subject to the following conditions:
    1.
    Petitioner commence construction of the pretreatment
    facilities as set forth in Respondent’s Exhibit No.
    16 in
    PCB 74—213.
    2.
    Petitioner not allow its effluent to exceed 30—day
    averages of 150 mg/i for BOD5 and 80 mg/i for suspended solids.
    3.
    Petitioner shall post a performance bond of $100,000,
    in a form acceptable to the Agency, within 35 days of the date
    of this Order.
    4.
    Within
    35 days of the adoption of this Order,
    Spinney
    Run Farms shall execute and forward to the Environmental Protection
    Agency, Air Division,
    2200 Churchill Road,
    Springfield, Illinois
    62706, a certificate of acceptance
    in the following form:

    having read and fully understood the Order of the Illinois
    Pollution Control Board
    in PCB 74-347 hereby accept said
    Order, understanding that such acceptance is irrevocable
    and renders binding all terms and conditions thereof.

    is dismissed as moot.
    Variance from Rule 405
    is denied.
