On November 21, 2005, the Environmental Protection Agency (Agency) filed a proposal
for rulemaking. The Agency proposes to the Board, pursuant to Public Act 94-272 (P.A . 94-
272), regulations for the use of clean construction or demolition debris (CCDD) as fill material in
current and former quarries, mines, and other excavations .

19, 2005). The Agency proposes the clean construction or demolition debris operations
regulations as a new Part 1100. The Agency's proposed Part 1100 would consist of four
subparts, which include: (1) general provisions; (2) standards applicable to CCDD landfills ; (3)
information that permits are required to include; and (4) procedural requirements for permit

applicants. P.A. requires the Board to adopt rules no later than September 1, 2006 .

The
Board accepted this matter for hearing on December 1, 2005 .
The Board will hold at least two hearings in this matter . Both hearings will be conducted
to allow the proponent and all other interested parties the opportunity to present testimony on the
merits and economic impact of the rulemaking proposal. At hearing, all persons who testify will
be sworn in and subject to questioning . The Board will also receive any testimony on any
economic impact study (EcIS) conducted by the Department of Commerce and Economic
Opportunity (DCEO) on the proposed rules or DCEO decision not to perform an EcIS
.
The Notice List for this rulemaking is the list of persons who wish to receive only the
Board's opinions and orders and hearing officer orders . The Service List is the list of persons
who wish to actively participate in this proceeding and receive not only opinions and orders, but
also other filings such as prefiled testimony and public comments. The Notice and Service Lists,
as well as the Agency's proposal, for R06-19 are available on the Board's website through the
Clerk's Office On-Line (COOL) atwww.ipcb.statc .il.us .
Persons who plan to testify must prefile their testimony and serve the testimony on the
hearing officer and all persons on the service list . Before filing any document with the Clerk,

officer, or the Clerk's Office for the most recent version of the Service List. The hearing officer

testimony for the first hearing must be submitted no later than January 16, 2006 . The prefiling
deadline for the second hearing is February 17, 2006. Timely submission of these materials by
all persons is essential to meet the September 1, 2006 deadline of this docket
