HEARING OFFICER ORDER
On December 7, 2005, a telephonic status conference was held. The complainant
represented that it appears that a settlement with First Rockford Group, Inc., and the Village of
Cherry Valley has been reached. Respective stipulations and proposals for settlement are or will
be circulated for review and signatures. The complainant represented that discussions with
Schlichting & Sons Excavating (Schlichting), but is not optimistic that a settlement will be
achieved. Schlichting is reminded that its answer is due to be filed on or before January 9, 2006.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on January 4, 2006, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
