On March
30, 1973 we received an amended petition in response
to our order of March 15,
1973 requesting additional
information.
The
amended petition is
still inadequate since uno facts are given
as
to the damage
to the environment that will result from the
grant of this variance” as stated in our earlier order.
The Village should list effluent discharges
as compared to
standards and should delineate
the effects now felt upon the
receiving stream
as well as future conditions which would occur
if the variance were granted.
Since written objections have been received by the Board in
this case a hearing is mandatory under Section
37 of the Environmen-
tal Protection Act.
Petitioner is given 30 days
from the date
of
this order
to file a second amended petition and a hearing will be
scheduled.
The petitioner shall file
a
30-day waiver of its right
to a decision within the 90-day period specified in Section
38 of
the Act or the petition will be subject
to dismissal as being in-
adequate.
