    Adopted Rule. Final Order.
    OPINION AND ORDER OF THE BOARD (by N.J. Melas):
    Pursuant to Sections 7.2 and 13.3 of the Illinois Environmental Protection Act (Act)
    (415 ILCS 5/7.2 and 13.3 (1998)), the Board proposes amendments to the Illinois wastewater
    pretreatment regulations. Section 13.3 of the Act provides for quick adoption of regulations
    that are identical-in-substance to federal wastewater pretreatment regulations adopted by the
    United States Environmental Protection Agency (USEPA) pursuant to Sections 307(b), (c), and
    (d) and 402(b)(9) of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C. §§ 1317(b),
    (c), (d), 1342(b)(9) (1996)). Section 13.3 of the Act also provides that Title VII of the Act and
    Section 5 of the Administrative Procedure Act (5 ILCS 100/5-35 and 5-40 (1998)), do not
    apply to this rulemaking. Accordingly, this rulemaking is not subject to first or second-notice
    review by the Joint Committee on Administrative Rules.
    Section 7.2(b) of the Act (415 ILCS 5/7.2(b) (1998)) requires the Board to complete its
    identical-in-substance rulemaking actions within one year of the date of the earliest federal
    amendments involved in a docket. In this docket, the earliest federal action requiring Board
    action occurred on August 4, 1999. Therefore, the Board must complete its rulemaking activity
    in this docket prior to August 4, 2000.
    FEDERAL ACTIONS CONSIDERED IN THIS RULEMAKING
    This proposed rulemaking incorporates certain federal amendments that occurred during
    the period of July 1, 1999, through December 31, 1999. The federal wastewater pretreatment
    regulations are found at 40 C.F.R. §§ 400-499, interspersed throughout the federal wastewater
    effluent discharge rules. The USEPA amended its wastewater pretreatment regulations three
    times during that period: August 4, 1999; September 2, 1999; and December 30, 1999. This
    rulemaking incorporates all of those actions.
    The federal amendments incorporated into this rulemaking are summarized as follows:

    Summary
    Standards for the Use or Disposal of Sewage
    Sludge. The USEPA amended regulations
    regarding the land application, surface disposal,
    and incineration of sewage sludge. The
    USEPA added a concentration for total
    chromium in land applied sewage sludge to the
    list of pollutants that are eligible for a removal
    credit.
    Correcting amendments for Pharmaceutical
    Manufacturing Effluent Limitations Guidelines,
    Pretreatment Standards, and New Source
    Performance Standards. The USEPA corrected
    amendments made in a final rule published on
    September 21, 1998 (63 Fed. Reg. 50388).
    Guidelines Establishing Test Procedures for the
    Analysis of Pollutants; Available Cyanide in Water.
    The USEPA amended its guidance on the
    analysis of cyanide in water for the purposes of
    compliance with the water quality requirements
    of the Clean Water Act.
    PUBLIC COMMENTS
    The Board adopted a proposal for public comment in this matter by order dated May 4, 2000.
    The proposal appeared in the May 26, 2000 issue of the
    Illinois Register
    . The Board accepted public
    comments on the proposal for a 45-day period following publication in the
    Illinois Register.
    The
    comment period expired on July 10, 2000. The Board received no comments during the public
    comment period.
    DISCUSSION
    August 4, 1999: Standards for the Use or Disposal of Sewage Sludge
    Federal Action
    The USEPA amended regulations regarding the land application, surface disposal, and
    incineration of sewage sludge. The USEPA added a concentration for total chromium in land
    applied sewage sludge to the list of pollutants that are eligible for a removal credit. The
    amendments to 40 C.F.R. 503 are promulgated pursuant to Section 405 of the Clean Water Act

    (CWA). 33 U.S.C. § 1345 (1996). The amendments to 40 C.F.R. 403 are promulgated
    pursuant to Sections 307 and 405 of the CWA. 33 U.S.C. §§ 1317 and 1345 (1996). Persons

    Amendment to Board Rules
    The Board incorporates this amendment into its rules by updating a single incorporation

    September 2, 1999: Correcting amendments for Pharmaceutical Manufacturing Effluent
    Limitations Guidelines, Pretreatment Standards, and New Source Performance Standards

    December 30, 1999: Guidelines Establishing Test Procedures for the Analysis of Pollutants;
    Available Cyanide in Water
    Federal Action
    On December 30, 1999, the USEPA amended its guidance on the analysis of cyanide in
    water for the purposes of compliance with the water quality requirements of the CWA. The
    final regulation amends the “Guidelines Establishing Test Procedures for the Analysis of
    Pollutants” under Section 304(h) of the CWA by adding Method OIA-1677: Available Cyanide
    by Flow Injection, Ligand Exchange, and Amperometry. Method OIA-1677 employs flow
    injection analysis to measure “available cyanide” and is an additional test procedure for
    measuring the same cyanide species as are measured by currently approved methods for
    cyanide amenable to chlorination. Persons interested in a more detailed discussion of the
