    ORDER OF THE BOARD
    (by G.
    P. Girard):
    On July 24,
    1995 the Illinois Environmental Protection
    Agency
    (Agency)
    filed a Motion for Extension of Time in Which to
    File Agency Record with regards to PCB 95-125.
    On July 31,
    1995
    West Suburban Recycling and Energy Center,
    L.P.
    (West Suburban)
    filed a Response to Motion for Extension of Time.
    West Suburban filed a Petition for Review of Denial of Air
    Quality Construction Permit with the Board on July 3,
    1995.
    The
    Agency received the petition on July 6,
    1995.
    Pursuant to Board
    procedural rule 105.102(a) (4),
    the Agency was required to file
    the entire Agency record of the permit application with the Board
    within 14 days of notice of the petition.

    The Agency record was therefore due on July 20,
    1995.
    In the instant motion the Agency requests an extension to
    file the record until October
    8,
    1995 and claims that the
    petitioner has agreed to the extension.
    West Suburban’s response motion states that it did not and
    does not agree to an Agency extension until October 8, 1995 to
    file the record.
    However, West Suburban agrees to an Agency
    extension until September 15,
    1995 and states that the Agency has
    agreed.
    In consideration of the October 11,
    1995 hearing scheduled
    in this matter, the Board hereby grants the Agency until
    September 15,
    1995 to file the Agency record of the permit
    application in PCB 95-125.
    IT IS SO ORDERED.
