HEARING OFFICER ORDER
On June 16, 2004, the petitioner informed the hearing officer that discussions have been
ongoing and that the parties are close to a resolve but for a few minor issues. Once the
remaining issues are settled, the petitioner anticipates that it will file a motion to voluntarily
dismiss the above-captioned permit appeal.
The parties or their legal representatives are directed to participate in a telephonic status
conference call with the hearing officer on August 5, 2004, at 9:15 a.m. The status conference
must be initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss is filed prior to the next status conference, the conference will be cancelled without
further order.
