    On September 27,
    1993, the Environmental Protection Agency
    (Agency)
    filed its “Motion for Leave to File Instanter and the
    Motion for Extension of Time to File Agency Recommendation.”
    The
    Agency seeks leave of the Board to file its motion for extension
    instanter.
    The Board grants this motion for leave to file the
    Agency’s motion for extension.
    In support of its motion for
    extension of time, the Agency states that it has referred an
    action to the Attorney General involving similar issues as those
    in the variance action.
    The Agency notes that preparation of the
    related action prevented the Agency from filing its
    recommendation by the September 17,
    1993 due date.
    The Agency
    intends to file its recommendation on or before October 18,
    1993.
    On September 27,
    1993, Atlanta filed a “Response
    to Motion
    for Leave and Motion for Extension.”
    Atlanta indicates that it
    has no objection to the extension and is in agreement with
    statements made by the Agency in its motion.
    Atlanta also filed
    a waiver of the decision deadline through January 31,
    1994.
    The Board grants the Agency’s motion for extension of time
    to file its recommendation.
    The Agency recommendation is to be
    filed on or before October 18,
    1993.
