On December
4,
1980, Complainant moved to dismiss
this
complaint filed April
11,
1977, without prejudice.
Respondent
has made no objection to this motion.
The motion states that an agreed compliance plan was
outlined at a hearing held October 10,
1977.
However,
no written
stipulation was filed then or later.
The motion further states
that as of October 22,
1980 effluent and reporting problems had
been basically resolved.
The
Board would normally require that a stipulation be filed
pursuant to Rule 331.
However, given the age of this action, and
in view of the fact that the problems complained of have been
“basically” resolved,
the Board hereby dismisses the complaint.
