ORDER OF THE BOARD

Anderson):
On June
16,
1988, the Board adopted an Opinion and Order
amending the RCRA regulations.
The Order provided that the Board
would withhold filing of the rules
for
30 days to allow time for
motions for reconsideration by the agencies involved
in the
authorization process.
On July 21, 1988,
the United States
Environmental Protection Agency filed
a final comment indicating
no objection to filing of the rules.
On July 22, 1988,
the
Illinois Environmental Protection Agency
(Agency)
filed
a request
for extension of time to file
a motion
for reconsideration,
and
on August
1,
1988
a motion for reconsideration.
The Board initiated the process of filing the rules on July
19,
1988.
Although the rules were not accepted for filing prior
to receipt of the Agency request for extension, granting
the
extension would have involved recalling the package from the
Administrative Code Unit.
The motion
is now denied as moot.
The motion for reconsideration addresses the multi—state
questions discussed
in the Opinion in connection with Sections
728.140 and 728.142.
The motion does not object
to the text of
the rules as filed.
As discussed
in the Opinion,
USEPA forwarded this question
to headquarters, but indicated that the rules will be
acceptable.
In that the Board anticipates hearing more about
this in the future,
the Board will not further address the
question
in this Docket.
The Board will docket the Agency’s
motion as public comment in R88—l6.
