The last hearing on this matter was held on July 23,

A subsequent hearing scheduled for September

cancelled

so as to enable American Brick Company to complete

certain modeling studies and

to make them available to the

Illinois Environmental Protection Agency prior

to hearing.

Since

that time no further progress towards completing the record

in

this matter has been made.

The Board hereby orders American

Brick Company to file a statement as to the status of its

modeling study and whether it intends to proceed with its request

for regulatory relief within

30 days of the date of this Order or

be subject to dismissal of this docket.
