I dissent from the Board’s opinion in this matter to

reiterate my concern in R96-2 Emergency Rule Amending 7.2 psi

Reid Vapor Pressure Requirement in the Metro—east Area,

35 Ill.

Adm. Code 219.585(a)

(February 23, 1995).

I dissented in R96—2

because I believed that it did not meet the statutory

requirements for an emergency rulemaking, and that the May 1st

deadline should have remained effective.

Since the change in the

May 1st deadline is applicable to the present rule,

I dissent

from this as well.
