This petition,
filed December
21,
1987,
requests an
exemption from the requirements of
35
Ill.
Adm. Code Part 215,
Subpart
Q
for USI’s plants located near Morris,
Illinois and near
Tuscola,
Illinois.
The petition was not accompanied by at least
200 signatures as
required
by Section
28
of the Act where
a
petition has not been filed by the Agency or DENR.
On December
28,
1987, the Agency filed
an objection
to waiver by the Board
of
the signature requirement.
In cases such as
this,
the Board sees little point
in
refusing
to accept such
a petition without signatures,
since
in
the usual course the petitioning company would simply circulate
such petitions
to their employees
(and their friends and
families)
to obtain the necessary signatures; presence of such
signatures does not indicate support
for the petition
in the
general community.
The petition
is accepted for hearing, which
will be
scheduled as expeditiously as
is practicable consistent
with the Board’s
informational needs and available resources.
