This matter comes before
the Board upon an April
4,
1989
filing by the Chicago Lung Association (~ssociation).
The
Association submitted
a proposed rule
to set limits on the
volatility of gasoline,
along
with
a
statement of reasons
to
support
its proposal and
a motion to waive
the signature
requirement of
35
Iii.
Adm.
Code 102.121(a).
The Association’s
motion
is hereby granted.
However, before
the Board can accept the proposal and
proceed
to hearing, the recently added requirements of Section
27
of the Act,
as amended, must
be satisfied.
Specifically,
a
recommendation
of whether an economic study
is advisable must
be
included
as part of the proposal,
and a copy of the proposal must
be filed with the Illinois Environmental Protection Agency
(Agency) and
the Department of Energy and Natural
Resources
(Department).
The Board also notes that Section
27(a)
requires:
the person filing
a proposal shall
describe,
to the extent reasonably
practicable,
the universe of affected sources
and facilities and
the economic
impact of the
proposed
rule.
Until
these
requirements are satisfied,
the Board cannot proceed
further.
