On August 13, 1986,
the Illinois Environmental Protection
Agency (“Agency”)
filed
a Motion
for Modification of the Board’s
May 22,
1986, Scheduling Order.
That motion requests the Agency
be allowed
to present testimony at the September hearings by a
witness from the United States Environmental Protection Agency
(“USEPA”) and
that such testimony include
a filing not later than
August 22, 1986,
on the general policy statements the witness
will make,
but that the specific pre—submission of testimony be
extended until a later
date.
Because
the motion was filed August
13,
1986,
and the testimony would be due August
22,
1986,
the
Board
is required to reach
a determination on this motion
today.
The motion
is granted and the Board’s May 22,
1986, Order
is modified
as follows:
The Agency
is authorized
to present
a witness
from USEPA
at
the September hearings
in
this
matter,
provided
that
not
later
than
August
22,
1986,
a
general policy
statement relating
to
the
witness’
testimony
is
filed
with
the
Board and the participants.
