    ORDER OF THE BOARD (by M. McFawn):
    Section 22.4(d) ofthe Environmental Protection Act (Act) requires theBoard to adopt
    regulations which are “identical in substance” to underground storage tank (UST) regulations
    promulgated by USEPA pursuant to Section 9003 ofRCRA to implement Subtitle I ofRCRA,
    with certain limitations.
    USEPA has codified its UST regulations at 40 CFR
    281
    through
    283.
    The Board reserved this docket for any UST amendments adopted by USEPA between July
    1
    and
    December 31,
    1995.
    Duringthat time period, USEPA amended its UST regulations once,
    on September
    7,
    1995,
    at 61 Fed Reg. 46711.
    Those amendments related to lender liability provisions ofthe
    financial responsibility requirements,
    which is
    subject
    matter expressly
    outside the scope ofthe
    Board’s statutory mandate.
    Therefore, theBoard hereby dismisses this docket.
