In the matter of

TOXIC SUBSTANCES REGULATIONS
ORDER DENYING POSTPONEMENT OR SUSPENSION
OF HEARINGS
(by Mr. Henss):
The Illinois Society of Professional Engineers and the
Illinois Fertilizer and Chemical Association have filed written
motions requesting that the Board table the pending proposals
or suspend hearings or postpone consideration of the proposal
until such time
as
a task force can he formed to draft
a new
proposal for the regulation of Toxic Substances.
The Environmental
Protection Agency opposes the written motions and objects
to
the formation of
a task force or an advisory board to draft a
new proposal.
The motions are denied.
It was the Environmental Protection
Agency which submitted the proposal in this matter and the Agency
has indicated its desire to proceed with the hearings without
the formation of
a task force or advisory board.
The Board
believes that under the Environmental Protection Act the Agency
does have that right.
Under the Act the Agency cannot be precluded
from making its proposals for the adoption of regulations and
from proceeding to present evidence in support of
those proposals.
The motions are hereby denied.
